THE
CONCERNED OWNERS AT CHELSEA TERRACE

A claim against Strata Plan VR1047 (Chelsea Terrace) was filed at the B.C. Civil Resolution Tribunal. The gist of the case revolves around the following:
over the past several years the Council of VR1047 has selectively and secretly waived the application of late interests for certain (but not all) owners who were delinquent on the payment of their Strata fees and Special Levies.
As a result certain owners (including several investors) were allowed to defer the payment of their Strata Fees at 0%, effectively allowing them to carry their properties for free while the rest of us were dutifully paying our monthly fees.
Our Bylaws are very clear: “if an owner is late in paying his or her strata fees, the owner must pay to the strata corporation interest on the late payment in the amount of 10% per annum, compounded annually” (By-laws were amended in 2021 with similar wording).
The Council failed to obtain our approval as Owners for this deviation in the application of our Bylaws.
More troubling the Council has kept this “deal” secret, has failed to publish any information in the Council Minutes, has failed to offer this financing facility to many Owners, and has steadfastly refused to answer our detailed request for further information on this matter when we confronted them.
4 current council members are implicated: 2 were Councilors at the time the waiver was in effect and 2 benefited from this waiver on thousands of dollars in late Strata fees and Special levies.
The Council has refused all our suggestions to settle this matter at no cost to the Strata corporation.
